Terms and Conditions

Please read these Terms carefully before accepting as they contain provisions that define your limits, your exercise of legal rights and obligations with respect to your use of our Services. By accessing and using our Services, you agree to be bound, without limitation or qualification, by these Terms. If you do not agree to be bound by these Terms, do not use the Services in any manner whatsoever or authorize or permit any other person or entity to do so. Any person who is not legally eligible to be bound by these Terms shall not access and use the Services. If you are not willing to agree to the foregoing, you should not click to affirm your acceptance thereto, in which case you are prohibited from accessing or using the Services. Nothing in these Terms shall be deemed to confer any third-party rights or benefits

While certain aspects of the Services or using certain Services, you will be subject to any additional terms applicable to such services that may be posted on the Service from time to time. All such terms are hereby incorporated by reference into these Terms of Service. The Services would be availed through the platform wherein our experts / mentors (Guides) would take /teach through the sessions as scheduled and communicated to you .

  • ELIGIBILITY:
    • You must be of 55 years or more in your province, territory, or country, and otherwise be fully able and competent to enter into, abide by, and comply with these Terms .The Platform Services are not available to minors i.e. persons under the age of 18 (eighteen) years or to any Users suspended or removed by the Company for any reason whatsoever. You represent that You are of legal age to form a binding contract and are not a person barred from receiving Platform Services under the applicable laws.
    • At any time during your use of our Services, we reserve the right to terminate your access without prior warning (i) if any information provided proves to be inaccurate, not current or incomplete; (ii) if it is believed that your actions may cause legal liability for you or us; and/or (iii) if you are found to be non-compliant with these Terms.
    • The Company reserves the right to refuse access to the Platform or Platform Services to new Users or to terminate access granted to existing User(s) at any time without any reasons for doing so.
    • You shall not have more than one active Account (as defined hereinafter) on the Platform. Additionally, You are prohibited from selling, trading, or otherwise transferring Your Account to another party or impersonating any other person for the purposing of creating an account with the Platform.
  • Event bookings

    • We try our best to price our classes/ workshops as fairly as possible and offer good value for money. We therefore have to have a clear cancellation policy to ensure that we cover our costs and the on-going viability of these sessions.

    We hence urge you to carefully check your diary to ensure that you are available to attend any sessions you are booking with us.

    Session registration can be done online and is confirmed only when full payment has been received from a participant. Bookings can be made up to 24 hours in advance of the session commencing if seats are available.

    1. If you need to cancel a class/ workshop
      We understand that despite a registrant’s best intentions they may find themselves unable to attend a session. Unfortunately, the fees to all our classes/ workshops are non-refundable. However, we will be happy to admit a friend (substitute) to take your place. We will need the name and contact details of the participating person prior to the class/workshop. The certificate of participation would be issued in the name of the person attending. The price differential in case of a basic vs. premium member may apply.
    2. Our cancellation and administration fee
      For online/virtual workshops:  Fees are non-refundable and non- transferable. For cancellation see  (1.)
    3. Our right to cancel a class/ workshop
      We reserve the right to make any changes to any aspect of any session without notice. Should we need to cancel a session due to unforeseen circumstances, we will aim to give registrants as much notice as possible of the cancellation. A full refund will be issued after deducting any applicable processing fee and other charges.
  • CHANGES OR MODIFICATIONS:

    • We may modify these Terms from time to time at our sole discretion. We will notify or let you know by posting the modified Terms on the Website. You shall, at all times, be responsible for regularly reviewing and noting the changes made to the Terms. Your continued use of our Services after the effective date of any change to the Terms will signify your assent to and will be deemed to be your acceptance of the modified Terms.

  • SYSTEM REQUIREMENTS:

    • For using the services in our Platform, you would require one or more compatible devices (mobile handset/computer/tablet ), Internet access (fees may apply), and certain software and may require obtaining updates or upgrades from time to time. Because use of the Services involves hardware, software, and Internet access, your ability to access and use the Services may be affected by the performance of these factors. High speed Internet access is recommended. Silver Talkies shall also not be responsible for any reduction in speed or efficiency of the Services due to poor connectivity or any other such collateral requirements related to internet services. You acknowledge and agree that such collateral system requirements, which may be changed from time to time, are your responsibility, and we shall not, under any circumstances whatsoever, be responsible or liable for such costs or performance .

  • USE OF THE PLATFORM

    • You shall be solely responsible for accessing and using our Services and shall ensure that you comply with laws of the territory while using our Services including but not limited to intellectual property, privacy, cookies and third party rights. You will use the Services only for such purposes as is permitted by (a) these Terms; and (b) any law, regulation or generally accepted practices or guidelines applicable in the country of which you are a citizen, in which you are a resident or from where you use the Services.

  • REGISTRATION AND LOGIN DETAILS

    • You need to register with Silver Talkies to access the platform and actively access all features in the platform as a User, through your account ("User Account") which can be created by filling your contact number to login . To create a User Account, you must submit the information requested for at the time of registration ("Registration Information") through your contact number and OTP will be generated which needs to be filled accordingly for its activation.

    Our information collection and use policies with respect to the privacy of such information are set forth in the Privacy Policy. You acknowledge and agree that you are solely responsible for the accuracy and content of the Registration Information, and you agree to keep it up to date.

    At any time after the registration, we reserve the right to suspend or terminate your User Account (i) if any Registration Information or any information provided thereafter proves to be inaccurate, not current or incomplete; (ii) if it is believed that your actions may cause legal liability for you, other End-Users or us; and/or (iii) if you are found to be non-compliant with these Terms.

    You are responsible for safeguarding your User Account details and password. You agree that you will not disclose your password to any third party and that you will take sole responsibility for any activities or actions under your User Account. You shall notify Silver Talkies immediately in case of any breach of security or any unauthorized use of your User Account. Similarly, you shall never use another person's User Account without prior consent from Silver Talkies. You agree that you will not misrepresent yourself or represent yourself on the platform. You hereby expressly acknowledge and agree that you will be liable for any losses, damages (whether direct or indirect) caused to you, Silver Talkies or any others as a result of unauthorized use of your User Account

    By agreeing to create a User Account, you may receive occasional special offer, marketing, and survey communication emails with respect to the Services/Content. You can unsubscribe from the Silver Talkies commercial emails by following the opt-out instruction in these emails

  • USER CONTENT

    • You acknowledge that you are responsible for any content you may submit through the Platform, including the legality, reliability, appropriateness, originality and copyright of any such content. You may not upload to, host, display, modify, transmit, update, share, distribute or otherwise publish through this Platform any content that:

    1. is confidential, proprietary, invasive of privacy or publicity rights, infringing on patents, trademarks, copyrights, or other intellectual property rights, unlawful, harmful, threatening, false, fraudulent, libellous, defamatory, obscene, vulgar, pornographic, paedophilic, profane, abusive, harassing, hateful, racially, ethnically or otherwise objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever, including, but not limited to any content that encourages conduct that would constitute a criminal offence, violates the rights of any party or otherwise gives rise to civil liability or otherwise violates any applicable laws for the time being in force;
    2. belongs to another person and to which you do not have any right to;
    3. violates any law for the time being in force;
    4. harms minors in any way;
    5. deceives or misleads the addressee about the origin of such messages or communicates any information which is grossly offensive or menacing in nature;
    6. threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognisable offence of prevents investigation of any offence or is insulting to any other nation;
    7. infringes upon or violates any third party's privacy rights (including without limitation unauthorized disclosure of a person's name, physical address, phone number or email address);
    8. provides material that exploits people in a sexual, violent or otherwise inappropriate manner or solicits personal information from anyone;
    9. interferes with another user's use and enjoyment of the Site or any other individual's user and enjoyment of similar services; or
    10. directly or indirectly, offer for trade, the dealing of any item which is prohibited or restricted in any manner under the provisions of any applicable law, rule, regulation or guideline for the time being in force;
    11. may contain software viruses or malware or files or programs designed to interrupt, destroy or limit the functionality of any computer;
    12. contains advertisements or solicitations of any kind, or other commercial content;
    13. is designed to impersonate others;
    14. contains messages that offer unauthorized downloads of any copyrighted, confidential or private information;
    15. contains multiple messages placed within individual folders by the same user restating the same point;
    16. contains identical (or substantially similar) messages to multiple recipients advertising any product or service, expressing a political or other similar message, or any other type of unsolicited commercial message; this prohibition includes but is not limited to (a) using the invitation functionality that may be available on the Site to send messages to people who do not know you or who are unlikely to recognize you as a known contact; (b) using the Site to connect to people who do not know you and then sending unsolicited promotional messages to those direct connections without their permission; or (c) sending messages to distribution lists, newsgroup aliases or group aliases.

      17. You may not use a false email address or other identifying information, impersonate any person or entity or otherwise mislead as to the origin of any content. Some features that may be available on this Site require registration. By registering, you agree to provide true, accurate, current and complete information about yourself.

  • INDEMNITY

    • You agree to indemnify and hold harmless Silver Talkies, its employees, directors, officers, agents, and their successors and assigns from and against any and all claims, liabilities, damages, losses, costs and expenses including attorney's fees caused by or arising out of claims based upon your actions or inactions, which may result in any loss or liability to Silver Talkies or any third party including but not limited to breach of any warranties, representations, undertakings, or any relation to non-fulfillment of any of your any obligations under this Contract arising out of your violation of any applicable laws, regulations including but not limited to intellectual property rights, payment of statutory dues and taxes, claim of libel, defamation, violation of rights of privacy or publicity, loss of service by other subscribers, and infringement of intellectual property or other rights. This clause shall survive the expiry or termination of this Contract.

  • TRADEMARKS

    • Information submitted, distributed, disseminated or posted to the Platform by you is your sole responsibility and the same shall be in accordance with applicable law. The Company reserves the right to review any topic/material/information provided/data uploaded, if any, by you on the Platform and delete any topic/material/information/data that is inconsistent with these Terms of Use.
